Terms and Conditions 

Full terms and conditions for The Burscough Cake Company are detailed below.  By paying your deposit it will be deemed that the terms and conditions are understood and accepted as applying to your order.

Payment Conditions 

Prices  

All prices are non-negotiable and priced according to your exact design and the size of your cake. 

Following your consultation/enquiry your quote is valid for up to 1 month for wedding cakes or 14 days for celebration cakes.  Paying your deposit will secure this price and the slot in the diary. 

Deposits  

A non-refundable deposit is required in order to secure the commission of your cake and chosen date.  

Dates are not reserved until a deposit has been received. 

Cheques are accepted for the deposit but cannot be used as payment method for the final payment.  Cheques should be made payable to S Giles. 

Payment of the final balance 

Payment should be made by bank transfer to First Direct in the name S Giles, SC 404761 Account 95289610.  All payments will be acknowledged via email.  

Final payment for your celebration cake can be made on the day of collection via cash or bank transfer prior to collection. 

Cheques cannot be used as payment for the final balance. 

If final payment in full is not received and cleared before cake collection/delivery then the order will not be released. 

Cancellation 

If cancellation of an order takes place we reserve the right to retain your non-refundable deposit. If cancellation takes place less than 7 days before the event then we reserve the right to retain 100% of the order value. 

Cancellation must be made in writing via letter, email or private message to The Burscough Cake Company and will only be deemed to take effect from the date your letter/email/message is received at our premises. 

If you postpone your event we will endeavour to transfer your order providing the date is available and suitable for ourselves, otherwise it will be treated as a cancellation. 

In the rare event where we need to cancel the booking due to circumstances beyond our control, such as fire or ill health, we will refund in full any payment received. 

Design Conditions 

Alteration and Changes 

It is your responsibility to read and check the quote thoroughly.  Any amendments to the agreed design should be made in writing. 

If requested, we will endeavour to adjust the design where possible, but sometimes this is not possible according to the nature of the request or amount of notice given.  If the alteration affects the cost, or preparation work for the original design has already been undertaken, then your balance will be adjusted accordingly.  If you are undecided on the design then this should be communicated to us when you pay your deposit. 

We reserve the right to change the design at any point if circumstances beyond our control may compromise the quality of the finished cake, e.g., melting due to hot weather. 

Each cake is made individually by hand and as such, although every effort is made to ensure consistency, a small amount of variation may occur from the design requested/picture supplied. 

Chocolate  

We advise caution if you are considering a cake decorated with chocolate in the summer (May to September). We cannot accept responsibility for any melting of the cake once it has left our possession as we have no control over the environment or venue temperature.  However, we can advise you of designs that are less susceptible to melting and do everything within our control to minimise impact on the cake. 

Flowers 

If your cake requires fresh flowers then these are not included in the quoted price unless specifically stated.   

If fresh flowers are used then the cake should be collected as late as feasibly possible to ensure their freshness for your event. 

The majority of fresh flowers are inedible and some are poisonous.  If you choose to have fresh flowers on your cake then The Burscough Cake Company accepts no responsibility for identifying which flowers are edible and which are poisonous, nor can we accept responsibility for ensuring that bits of cake that have been in contact with the fresh flowers are not consumed. 

Allergies and Special Dietary Requirements 

Special Requirements 

Please discuss with us if you have any special dietary requirements.  Cakes can be made gluten free and alcohol free.  Cupcakes can also be made dairy free and egg free. 

Please be aware, however, that although ingredients such as nuts can be removed from cakes they are still used in our kitchen so we cannot guarantee that any of our cakes are completely free of them. 

Non-edible items 

Our cakes may continue some inedible items such as supporting dowels in tiered cakes, posy picks for sugar flowers and cake toppers.  It is your responsibility to ensure that these are removed by your caterer/guests prior to consumption. 

Delivery conditions 

Delivery charges are calculated on a mileage and time basis.  Alternatively cakes can be collected from our premises. 

If you choose to have your cake delivered it is our intention that your cake will be delivered in perfect condition prior to the start of your event.  However we cannot be held liable for factors beyond our control, such as traffic problems, which may result in a delay to the arrival of your cake.  It is your responsibility to inform us of the correct venue and event time.  In the unlikely event of late delivery we will refund you the delivery price. 

We cannot be held liable for any damage that is rendered to the cake at the venue once we have left the premises. 

If you choose to collect the cake we will not be held liable for any damage to the cake once it has left our premises.  Tiered cakes are most likely to be damaged in transit. 

Storage and Consumption 

Damage 

Cake decorations are very delicate items and we cannot be held responsible for damage to the cake or cake decorations once it has left our possession. 

Portion Guide 

Portion guides are intended as a guide only and will vary dependant upon how the cake is cut.  

Best Before Date and Storage Conditions 

Your cake is baked to ensure it is fresh for the date of your event.  We cannot guarantee its quality if it’s consumed more than 48 hours after the event. 

Freezing the cake preserves the taste of the sponge and icing as much as possible but may affect the visual appearance of the cake as condensation will form upon defrosting.  Cake should only be frozen for a maximum of three months. 

If you would like us to leave the cake boxes on site so that you can transport any tiers of the cake after the event you should inform us prior to the event. Otherwise we will remove all cake boxes from the venue. 

Cakes with sugarpaste/fondant icing should not be refrigerated as it will cause condensation to form on the surface of the icing.  Refrigeration also accelerates the cake drying out.  Once sponge is exposed to the air it will begin to dry out, therefore once a cake has been cut it should be stored in the cake box with the lid on in a cool dry place. 

Hire of Cake Stands/Accessories 

If you would like to hire a cake stand or decoration a cash bond is required.  Bond amounts will be calculated to cover the cost of the of the value of the item being hired. 

Please make arrangements to ensure that hired items are safely returned within 7 days of the event. 

Bonds will be returned once the hired item has been returned and inspected to confirm that no damage has occurred. 

Complaints 

If you have any concerns regarding your cake please notify us immediately upon delivery/collection so that we have the opportunity to rectify it in time for your event.  All other concerns should be made in writing together with evidence of the fault included. 

Refunds are at the discretion of The Burscough Cake Company.
